These terms apply to the website thecyclops.app and to the Cyclops app for Mac. Both are provided by Carl Moebis, an independent developer based in the United States (“I”, “me”). By using the website or the app, you agree to these terms. If you don’t agree, please don’t use them.
The app
If you get Cyclops from the Mac App Store, your licence to use it is governed by Apple’s Licensed Application End User License Agreement (the “Standard EULA”), and these terms apply alongside it where they don’t conflict. Apple has no obligation to provide support for Cyclops.
You may use Cyclops on Macs you own or control. You may not copy, modify, reverse engineer, resell or redistribute it, except as the law or the Standard EULA allows.
Third-party services
Some features work with apps and services made by others, such as Apple Music, Apple Notes, Spotify, Codex (OpenAI) and Claude (Anthropic). Your use of them is governed by their own terms. Cyclops isn’t affiliated with or endorsed by them. Features that depend on them may change or stop working if they change, and figures read from them may be delayed or inaccurate.
The website
You’re welcome to browse the website and share links to it. Please don’t misuse it: no attempts to disrupt, overload or gain unauthorised access to it, no automated bulk access, and no use of the support form for spam or unlawful content. The interactive demo is a simulation that uses fictional data.
Your feedback
If you send ideas or suggestions, I may use them to improve Cyclops without any obligation to you. Please don’t send confidential information through the support form.
Ownership
The Cyclops name, logo, app icon, mascot, launch film, and the website’s design and content belong to Carl Moebis and are protected by intellectual property laws. Other names and trademarks belong to their owners; see the Disclaimer.
No warranty
Cyclops and the website are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. I don’t promise that they will be uninterrupted, error-free, or compatible with every Mac, display or future version of macOS.
Limitation of liability
To the fullest extent permitted by law, I’m not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or revenue, arising from your use of Cyclops or the website. My total liability for any claim is limited to the amount you paid for Cyclops in the twelve months before the claim, or US$50 if you paid nothing. Some places don’t allow these limits, so they may not apply to you.
Your consumer rights
Nothing in these terms limits rights you have as a consumer under the mandatory laws of the country where you live.
Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, unless the mandatory law of your country of residence lets you bring a claim in your local courts.
Changes
I may update these terms; the date at the top shows the current version. If you keep using Cyclops or the website after a change, the updated terms apply. I may stop offering the website, the app or any of their features at any time.
